1. Agreement to Terms
These Terms of Service (the “Terms”) are a binding agreement between you (“you,” “your,” or “Customer”) and Bootstrapper LLC (“Bootstrapper LLC,” “we,” “us,” or “our”), the operator of the PDFgen website, applications, and API (collectively, the “Service”). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, you may not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
2. The Service
PDFgen is a software platform that lets you generate document templates from natural-language prompts using artificial intelligence, edit and save those templates, populate them with your data, and render PDF documents — including through a programmatic REST API. We may add, modify, or remove features at any time. We do not guarantee that any particular feature will remain available.
3. Accounts and Security
To use most features you must create an account using a supported sign-in method (such as email, Google, or GitHub). You agree to provide accurate information and to keep it current. You are responsible for all activity that occurs under your account and for safeguarding your credentials and API keys. Notify us promptly at support@pdfgen.com if you suspect unauthorized use. We are not liable for any loss arising from unauthorized use of your account.
4. Plans, Billing, and Refunds
The Service is offered on free and paid subscription plans. Paid plans are billed in advance on a recurring (monthly or annual) basis through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
- Renewals. Subscriptions renew automatically at the then-current rate unless cancelled before the end of the current billing period.
- Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain paid access until then.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused credits.
- Taxes. Fees are exclusive of taxes; you are responsible for any applicable sales, use, VAT, or similar taxes.
- Price changes. We may change prices on a prospective basis with reasonable notice; changes take effect on your next renewal.
5. Credits and Usage Limits
Usage of certain features — including PDF generation — is metered in credits and may be subject to plan-based quotas and API rate limits. Credits are consumed as described in the Service and have no cash value, are non-transferable, and may expire at the end of a billing period unless otherwise stated. We may apply rate limiting, throttling, or temporary suspension to protect the integrity and availability of the Service.
6. Acceptable Use
You agree not to, and not to permit any third party to:
- use the Service to create, store, or distribute content that is unlawful, fraudulent, defamatory, infringing, or that violates the rights of others;
- generate forged, counterfeit, or deceptive documents — including fake identification, fraudulent invoices, or instruments intended to deceive;
- upload or transmit malware, or attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
- probe, scan, overload, or circumvent rate limits, credit metering, or any security or authentication mechanism;
- reverse engineer, resell, or build a competing product from the Service except to the extent permitted by law;
- use the Service to violate any applicable law, regulation, or third-party terms, or in connection with high-risk activities where failure could lead to death, injury, or environmental damage.
We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe violates these Terms or harms the Service or other users.
7. AI-Generated Content
The Service uses third-party large language models to generate templates and content based on your prompts. AI output may be inaccurate, incomplete, or unsuitable for a particular purpose, and similar prompts may produce similar output for different users. You are solely responsible for reviewing, editing, and validating any AI-generated content before relying on or distributing it. The Service does not provide legal, financial, medical, tax, or other professional advice, and AI-generated documents (such as contracts or agreements) are not a substitute for review by a qualified professional.
8. Your Content
“Your Content” means the prompts, data, images, templates, and other materials you submit to or generate with the Service. As between you and us, you retain all ownership rights in Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and transmit Your Content solely to operate, provide, secure, and improve the Service, and as otherwise described in our Privacy Policy.
You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe any third-party rights or violate any law. You are responsible for maintaining your own backups; we are not a backup or records-retention service.
9. API and API Keys
We provide an API to generate PDFs and manage templates programmatically. API keys are confidential and are issued per account. You are responsible for all use made with your keys, for keeping them secret, and for rotating or revoking them if compromised. We may modify, deprecate, or rate-limit the API, and we maintain logs of API usage for billing, security, and operational purposes.
10. Intellectual Property
The Service, including its software, design, trademarks, and documentation, is owned by Bootstrapper LLC and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. PDF documents you generate from your own data and templates are yours to use. We welcome feedback, and you grant us a perpetual, royalty-free license to use any feedback you provide without obligation to you.
11. Third-Party Services
The Service relies on third-party providers, including for AI inference, payment processing, email delivery, authentication, hosting, storage, and analytics. Your use of those features may be subject to the third party’s terms, and we are not responsible for third-party services. If you connect your own storage (for example, an S3 bucket), you are responsible for that configuration and its security.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay fees, or use the Service in a way that creates risk or legal exposure for us or others, or if we discontinue the Service. Upon termination, your right to use the Service ends and we may delete Your Content after a reasonable period. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOTSTRAPPER LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless Bootstrapper LLC and its officers, members, and employees from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the State of Washington, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. You and Bootstrapper LLC agree that any claim must be brought in an individual capacity and not as part of a class action.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
